The promoter is: SeventySeven Wealth Management Limited of The Old Granary, Tong Lane, Lamberhurst, Tunbridge Wells, Kent, England, TN3 8AD.
2.1 The title of the competition is Leeds Classical Concert Spitfire Competition.
2.2 Win a flight for one in a Spitfire. Text 77SPITFIRE followed by your email address to 60006 for your chance to win. Texts will cost your standard network rate of your provider.
3.1 The competition will run from 14:30:00 on 14th July 2018 (the “Opening Date”) to 23:59:59 on 20th July 2018 (the “Closing Date”) inclusive.
3.2 All competition entries must be received by the Promoter by no later than 23:59:59 on the Closing Date. All competition entries received before the Opening Date and after the Closing Date are automatically disqualified but you may still be charged the standard network rate by your mobile network operator.
3.3 To enter the competition send a text to 60006 with the words “77SPITFIRE” followed by your email address by the Closing Date. The cost of the text will be your standard network rate. This is the only means of entry.
3.4 No purchase necessary.
3.5 The Promoter will not accept:
(a) responsibility for competition entries that are lost, mislaid, mistyped, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
(b) proof of transmission as proof of receipt of entry to the competition.
3.6 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.
4.1 The competition is only open to all residents in the UK aged 18 years or over, except:
(a) employees of the Promoter or its holding or subsidiary companies;
(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
(c) members of the immediate families or households of (a) and (b) above.
4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize and agree to be bound by the rules and requirements set out in these Terms & Conditions. The Promoter may require you to provide proof that you are eligible to enter the competition.
4.3 The Promoter will not accept competition entries that are:
(a) automatically generated by computer;
(b) completed by third parties or in bulk;
4.4 There is a limit of one entry to the competition per mobile phone telephone number. Where duplicate entries are identified the first one received will be entered into the draw.
4.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.
5.1 The prize is a flight in a Spitfire, which will take off and land at an aerodrome which will be confirmed to the competition winner by the Supplier as soon as possible after the Announcement Date but could be anywhere in England and Wales, and only one trip is available to be won.
5.2 The flight is provided by Aero Legends Ltd of The Carriage House, Mill Street, Maidstone, Kent, ME15 6YE with Registered Company Number 7627016 (“the Supplier”).
5.3 The prize does not include the expenses and arrangements for travel to and from the nominated aerodrome, any (if any) travel insurance, the cost of transfers to and from stations, food and drink, spending money, tax or any other personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner.
5.4 You will be responsible for ensuring that you provide all documentation required by the Supplier in the course of scheduling the Spitfire flight.
5.5 There is no cash alternative for the prize. The Promoter reserves the right to substitute the prize with a prize of equal or greater value.
5.6 The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so.
5.7 The prize is not negotiable.
6.1 The winner of the competition will be announced on the SeventySeven Wealth Management Website (www.77wm.co.uk/win) on 23rd July 2018 (“Announcement Date”).
6.2 The decision of the Promoter is final and no correspondence or discussion will be entered into.
6.3 The Promoter will contact the winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry.
6.4 The Promoter will send the name and county of the winner to anyone who writes within one month after the Closing Date of the competition requesting details of the winner.
6.5 The winner agrees to the use of their name, photograph and disclosure of town or residence and will co-operate with any other reasonable requests by the Promoter relating to any post-winning publicity and/or coverage on the Promoter’s website.
7.1 If you are the winner of the prize, you will have fourteen of days from the Announcement Date to claim the prize by submitting a text or calling to confirm your full name to the SeventySeven Wealth Management corporate mobile number, 07555 474614, from the mobile number used to submit the competition entry. If you do not claim the prize by this date, your claim will become invalid.
7.2 Please note the cost of the text or phone call to verify your identity in clause 7.1 will be your standard network rate.
7.3 The prize may not be claimed by a third party on your behalf.
7.4 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within fourteen of days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the entries that were received before the Closing Date.
7.5 The Promoter does not accept any responsibility if you are not able to take up the prize.
7.6 The prize is subject to the Supplier’s terms and conditions (full terms & conditions can be seen at www.aerolegends.co.uk and follow the link to ‘Terms’) including, but not limited to, that the winner:
(a) Must be 18 years or over;
(b) Must provide phone ID (Passport or Driving Licence) in order to validate age;
(c) Must not be more than 198cm tall;
(d) Must weigh less than 105kg and must give permission to be weighted on the day;
(e) Must be able to work 50 meters un-aided;
(f) Must declare that they have never suffered from any of the following which may create or lead to a dangerous situation in flight: blackouts from any cause; epilepsy; severe head injury; recurrent fainting or giddiness; high blood pressure; angina; coronary heart disease; insulin dependent diabetes; any nervous disorder; or other relevant illness or injury;
(g) Must not have blocked sinuses so they are able to equalise the pressure in their ears by blowing into their closed nose; and
(h) Must not be suffering from the effects of alcohol or drugs.
7.7 Where the winner does not meet the above criteria stated at clause 7.5 the prize may be transferred to an alternative individual, who will be subject to these terms and conditions, nominated by the winner.
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter or that of their employees. Your statutory rights are not affected.
9.1 The Promoter does not claim any rights of ownership in your competition entry.
10.1 The Promoter will only process your personal information as set out in the Privacy Notice located at www.77wm.co.uk and follow the ‘Legal’ link.
11.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
11.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
11.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
